and myself wore up to the Sheriff's office and Bale told mo up there to 
go see Ernest Burkhart and John Ramsey and tell them to sit steady, that 
ho. Bale, would take care of everything* While ac route from Fairfax to 
Pawhuska, Bala remarked to Pitts Beatty and Lysalf that M night b& 
arrested on the Henry Roan case, as there had been setae tali about M* 
(Bale) being arrested, but he. Bale, did not heXlevo that he going 
to be arrested* 'While V« K. Bale did request of me to tell ay brother, 
Ernest Burkhart and John Ramsey to ait steady tfcfiT‘Sr, Bale, would taxi

About two weeks before Bale was arrested. In Da comber, 1926, ht f aala, 
cams down to my place and told me that thero had been soae^tali- going 
around that he, Hale, was going to b* arrested, but h* thought ths blame 
would be laid upon Roy Bunch* He, Hale, said* that ha had talked to Hoy 
Bunch and told him that he, Bunoh, had better leave the country* Ho said 
to me, you know that Roy Bunch as been going with Henry Rosa's T *ife quite 
a while, and I said yes* Hale said it would be enijr to lay the blame on 
Roy Bunch because he. Bunch, had been going u.wh £&•&.&*$ wile* 

Along in the fall, to the tsst of icy recollection, about ths first o i 
October, 1928, I met J* I* Howard, attorney for Ktle, et gcmlmy, 'OklaMtn, 
at which time Howard told me that if E nest would take the weight off of

I have known W* K* Bale for the past ten years - in fact, we 
been neighbors and friends, and, while Hr* Halo confined 
Pawhuska County Jail at pawhuska, Oklahoma, I visited him ea 
different occasion*, and 2£r* Hale has told ms several differ} 
that Ernest Burkhart was the only witness that he, Sale, wa;.

United States Attorney, Tulsa, Oklahoma, has written me as follows: 

"In the matter of United States v* W. K* Hale, the 
court this morning made an order continuing the hearing 
on his motion for new trial until February 23rd* 


In connection with hearing counself for Hale made 
some statement in court to the effect that probably an 
amended application or motion would be filed based on new- 
ly discovered evidence, which we assume might be in the 
way of affidavits obtained from persons with reference to 
some of the governments testimony introduced in the trial 
of this case, and in view of these facta, after consulta- 
tion with Mr. Hoy St* Lewis, we have deemed it advisable 
to request your office to allow Hr* John B* Burgsr to re- 
main on this case and until after 3uch motion for new trial 
is finally disposed of by the court, ard this letter is to 
request the further continuance of such an assignment of 
Mr* Burger to the case. " 

I have authorized Agent 3urger to continue on the ca3e 
at Pawhuska as requested by Mr, Goidesberry.
